The following are some examples of recent cases handled by the firm, current and recent press releases, announcements, and other news concerning the Law Office of James M. Thomas, Esq.

Auto Negligence:

Auto Settlement, $125,000.00.  Defendant commercial vehicle rear ended client's auto which was stopped at a stop sign.  Defendant failed to exercise proper caution and control of the vehicle he was operating and slammed into the auto client was riding in as a passenger. This resulted in significant personal injury to client.

Auto Settlement, $100,000.00, UM policy $50,000.00.  Defendant negligently placed the insured vehicle in violation of the right of way and in the path of client's vehicle causing the crash and significant personal injury to client.

Auto Settlement, $100,000.00  Defendant changed lanes when her tire had a blowout causing her car to fishtail.  Defendant overcorrected and began to spin out of control landing in front of client's carThe car then slid and spun around over the interstate and then off the road where our client's car actually flipped over after impact, finally landing in a ditch next to the interstate causing serious injury.

Auto Settlement, $50,000.00   Client slowed down to a stop with her left turn indicator on as she was going to turn left into her own driveway and began to turn left across the oncoming clear lane, another vehicle that was traveling in the same direction on the same road and attempted to pass our client on the left while speeding, and smashed into our client's right driver door area with such great force our client's vehicle was shoved all the way up near her house totaling her vehicle.   

Auto Settlement, $90,000.00.  Ticketed Defendant caused significant personal injury to client.

Auto Settlement, $100,000.00  Client  was rear ended by a DUI driver, a young white male in his 20's driving an older mid-size pick-up truck, who fled the crash site after stating he was "going to a local gas station to make a call", however he was apprehended and arrested by a Pinellas County Sheriff's Deputy within minutes of fleeing the crash site. Client underwent multiple surgeries as a result of the crash.

Auto Settlement, $20,000.00. Client was struck and injured by defendant's truck.  Upon impact, Client experienced soft tissue injury in neck and back area.

Auto Settlement, $20,000.00. Client was struck and injured by ticketed Defendant.  Upon impact, Client experienced soft tissue injury in neck and back area.

Auto Lawsuit Settlement, $20,000.00. Client was struck and injured by defendant's vehicle.  Upon impact, Client experienced acceleration and aggravation of a previously unknown existing condition. 

Auto Settlement, $18,000.00. Client was passenger on public bus struck by defendant's vehicle Upon impact Client experienced immediate back and neck pain, numbness and tingling radiating down the right leg and further experienced numbness and tingling in both hands, soft tissue injury.

Auto Settlement, $10,000.00. Client was struck and injured by defendant's vehicle.  Upon impact, Client experienced soft tissue injury in neck and back area.

Personal Injury:

Premises Liability Settlement, $25,500.00. Client was struck and injured by falling tree on Defendant's property. 

Premises Liability Settlement, $40,000.00. Client slipped and fell on cheese and water on a school walkway floor adjacent to a lunchroom while being lead through the area by a school employee.  As a result, client sustained severe damage to her kneecap.   

Premises Liability Settlement, $21,500.00. Client slipped and fell on poorly maintained common area of DefendantĄ¯s apartments sustaining serious injury.  

Products Liability Settlement, $5,000.00. Client purchased for consumption, hot dogs and/or sausage meat products, applied pickle relish and sliced pickles self-served from open canisters, which Client consumed resulting in food poisoning.

Products Liability Settlement, $4,500.00. Client's mouth was cut after ingesting a grocery store sandwich which contained broken glass from a fluorescent light tube.

Debt Collector/Creditor Harassment:

Settlement, $9,000.00. Defendant debt collector was not licensed to collect debts in Florida, threatened to garnish client's wages and file a lawsuit which debt collector did not do. Motion for punitive damages granted by the Court.

Settlement, $3,500.00 plus waiver of underlying debt approx. $5,600.00. Defendant creditor continuously sent agents to personally collect a debt from client while at work.

Settlement, $5,000.00. Defendant sued to collect a debt that had already been fully paid by client.

Settlement, $4,000.00. Defendant creditor withdrew money from client's checking account without permission.

Settlement, $4,700.00, deletion of trade line. Defendant credit reporting agency continuously reported false information on client's credit report after notice to cease.

Settlement, $4,800.00. Defendant creditor continuously faxed collection letters to client at work after notice to cease.

Settlement, $4,500.00. Defendant creditor wrongfully sued to collect a debt that had already been fully paid by client.

Settlement, $3,500.00. Defendant debt collector attempted to collect a debt that was discharged in bankruptcy.

Settlement, $4,500.00. Defendant creditor sent agents to personally collect debt from client while at work.

Settlement, $4,500.00. Defendant debt collector threatened client by repeatedly calling at home and on cell phone.

Settlement, $2,000.00, deletion of trade line. Defendant creditor continued to report debt on credit report as due and owing when it was fully paid years earlier.

Settlement, $5,000.00. Defendant creditor continued to withdraw money from client's checking account after debt was already satisfied.

Settlement, $4,500.00. Defendant creditor withdrew money from client's checking account in an amount greater than what client had authorized.

Settlement, $3,500.00. Defendant creditor attempted to collect from client/wife a debt that was solely in her deceased husband's name.

Consumer Law:

BBB Autoline Award, $42,000.00, Lemon Law Claim: Client complained of multiple problems with their General Motors van. The Law Office filed an original complaint with the Better Business Bureau/Autoline lemon law informal dispute resolution program.  At hearing, the BBB granted client's lemon law claim.  GM was required to pay client approx. $42,000.00 and take back their lemon!

Arbitration Award, $21,000.00, Lemon Law Claim: Client complained of continuous problems with the gear shifter mechanism and park lock assembly on client's General Motors vehicle. The Law Office filed an original complaint with the Better Business Bureau/Autoline lemon law informal dispute resolution program.  At hearing, the BBB denied client's lemon law claim.  Client appealed the decision to the Florida New Motor Vehicle Arbitration Board. After hearing before a panel of three board members, the board ruled in favor of the client and awarded a repurchase of the vehicle.  GM was required to pay client approx. $21,000.00 and take back their lemon!

Settlement $7,300.00, Cancellation of Mortgage: Client complained that "For Sale Buy Owner" a real estate marketing company slipped mortgage documents from a sister finance company into its advertising agreement package.   Salesman told client  that the documents were just "everything we already talked about, just sign them". Client signed not knowing what she was signing.  

Judgment, $15,286.00 Roofing Contractor botched roof replacement causing damage to client's residence.

Settlement, $6,000.00 plus new 2006 vehicle.  Dealer sold Client a 2004 vehicle that had been in serious accident, and did not disclose that fact before sale.  Dealer's agent made representations during negotiations as to the condition of the vehicle upon which the client relied to their detriment. 

Settlement, $7,500.00. Contractor botched home improvement causing damage to client's residence.

Judgment, $3,550.00, Junk Fax Case: single fax blast violation.

Civil Litigation:

Settlement, $66,543.00 Personal representative of a probate estate concealed information related to value of siblings share of the estate at issue.

Final Judgment, $122,563.65  Client solely funded a corporation and sought injunctive relief to protect assets from dissipation.  Client successfully sought dissolution of the corporation and return of the funds so invested. 

Settlement, $12,250.00 Client specifically contracted for climate controlled storage space, air conditioning unit failed, leaked moisture in units causing mold to completely cover items stored therein. Storage facility had knowledge of the air conditioning problem and failed to correct it.

Marital & Family Law:

Custody Granted Client was an out-of-state father who discovered that his Florida ex-wife's boy fried had beat his young son badly enough to cause surgical intervention. The child was first placed in custody of the state. After two emergency hearings, client/father was awarded primary residency and was further permitted to take his son to his home state!

Settlement Reached Client was wife of Doctor in a short marriage who used wife's premarital money to buy his way into a medical practice.  Contentious divorce litigation ensued.  Client was awarded $250,000 in settlement of the matter.
